1. Overview

This website is operated by D’Lighted Finds. Throughout this website, the terms “we,” “us,” and “our” refer to D’Lighted Finds.

D’Lighted Finds offers this website, including all information, products, features, and services available through it, conditioned upon your acceptance of these Terms of Service.

By visiting our website or purchasing a product from us, you agree to be bound by these Terms of Service, our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies posted on our website.

If you do not agree to these Terms of Service, you should not use this website or purchase products from us.

2. Eligibility and Website Use

You must be at least 18 years old or the age of legal majority in your state to make a purchase. Individuals under that age may use this website only with the involvement and permission of a parent or legal guardian.

You agree to use this website only for lawful purposes. You may not use the website:

• To violate any federal, state, or local law;

• To infringe upon another person’s intellectual-property rights;

• To submit false, misleading, or fraudulent information;

• To transmit viruses, malicious code, or other harmful material;

• To collect or track another person’s personal information without authorization;

• To interfere with the security or proper operation of the website; or

• To place fraudulent orders or engage in unauthorized payment activity.

We reserve the right to refuse service, restrict access, or cancel orders when we reasonably believe these Terms have been violated.

3. Product Information

We make reasonable efforts to display product descriptions, dimensions, colors, images, materials, and other details as accurately as possible.

However, colors and appearance may vary depending on your device, screen settings, lighting, and the printing or manufacturing process. Because many products are made to order, minor variations in color, placement, alignment, finish, or appearance may occur. These minor variations are not necessarily defects.

Product images may include mockups used to demonstrate how the finished product is expected to appear. Decorative items shown in product photographs are not included unless specifically stated in the product description.

4. Made-to-Order and Personalized Products

Many D’Lighted Finds products are made specifically for the customer after an order is placed. Production may begin shortly after payment is confirmed.

Customers are responsible for carefully reviewing all names, dates, messages, photographs, colors, sizes, and other personalization details before submitting an order.

We will produce personalized items using the information submitted with the order. D’Lighted Finds is not responsible for spelling, date, capitalization, punctuation, or other errors entered or approved by the customer.

Changes or cancellations may not be possible once production has begun.

5. Customer-Submitted Content

If you submit names, photographs, messages, artwork, graphics, or other content for personalization, you confirm that:

• You own the content or have permission to use it;

• The content does not violate another person’s copyright, trademark, privacy, publicity, or other rights;

• The content is not unlawful, threatening, hateful, obscene, defamatory, or otherwise inappropriate; and

• We may provide the content to our production and fulfillment partners solely as necessary to complete your order.

You retain ownership of eligible content you submit. You grant D’Lighted Finds and its service providers a limited, nonexclusive license to use, reproduce, resize, adjust, print, and process that content for order production, fulfillment, customer service, and recordkeeping.

We may refuse or cancel an order containing content that we reasonably believe violates these requirements. If production has not begun, any eligible refund will be issued according to our policies.

6. Prices, Payments, and Taxes

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, and product availability may change without notice. The price charged will be the price displayed at checkout when the order is submitted, subject to correction of obvious errors.

Payment must be completed using one of the payment methods available at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment processors to charge the total amount shown at checkout.

Applicable sales taxes and shipping charges will be calculated and displayed at checkout when required.

Promotional codes must be entered at checkout and cannot normally be applied after an order has been placed. Unless otherwise stated, discounts cannot be combined.

7. Errors and Inaccuracies

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or product availability.

We reserve the right to correct errors and update information at any time. If an error materially affects an order you have already placed, we will contact you before proceeding whenever reasonably possible.

If an order is cancelled because of a pricing or listing error after payment was collected, we will refund the amount paid for the cancelled item or order.

8. Order Acceptance

An order confirmation acknowledges that we received your order. It does not necessarily mean the order has been accepted for production or shipment.

We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons, including:

• Product unavailability;

• Pricing or listing errors;

• Suspected fraud or unauthorized payment activity;

• Problems verifying billing or shipping information;

• Content that violates these Terms; or

• Production or fulfillment limitations.

If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method.

We may limit or cancel quantities that appear to have been placed by resellers, distributors, or other unauthorized commercial purchasers.

9. Order Changes and Cancellations

Contact us as soon as possible if you need to request an order change or cancellation.

We will try to accommodate requests, but we cannot guarantee that an order can be changed or cancelled after it has entered production. Made-to-order and personalized products may become noncancelable once production begins.

If a cancellation is approved before production begins, the refund will be issued to the original payment method. Processing times imposed by banks or payment providers are outside our control.

10. Shipping and Delivery

Production time and shipping time are separate. Estimated delivery dates are estimates and are not guarantees.

Orders may be produced, packaged, and shipped by third-party print-on-demand and fulfillment providers, including AnywherePOD and/or DecoPlate, as applicable.

Customers are responsible for providing a complete and accurate shipping address. D’Lighted Finds is not responsible for delays, losses, or additional expenses caused by an incorrect or incomplete address submitted by the customer.

Once an order has been transferred to the shipping carrier, delivery may be affected by carrier delays, weather, natural disasters, holidays, customs processing, transportation disruptions, or other circumstances outside our reasonable control.

If we learn that an order cannot be shipped within the timeframe originally promised, we will provide notice and offer any cancellation or refund rights required by applicable law.

11. Lost, Stolen, or Misdelivered Packages

If tracking shows that a package is delayed or missing, please contact us so we can review the shipment and, when appropriate, assist with a carrier inquiry.

If tracking shows that the package was delivered but you cannot locate it, please first check with household members, neighbors, the delivery carrier, and any secure delivery location associated with your address.

We will review reported delivery problems individually. Replacement or refund eligibility will depend on the circumstances, available tracking information, carrier findings, and applicable law.

12. Returns, Refunds, and Final-Sale Products

Because made-to-order and personalized products are produced specifically for the customer, they are final sale and are not eligible for return or exchange merely because the customer changed their mind, entered incorrect personalization information, or selected the wrong product option.

This final-sale restriction does not apply when a product arrives damaged, defective, materially different from what was ordered, or when a return or refund is otherwise required by law.

Customers must follow the reporting timeframe and instructions stated in our Return & Refund Policy. We may require photographs of the product, packaging, shipping label, and damage so that we can evaluate the claim.

Approved refunds will normally be issued to the original payment method. Original shipping charges may be nonrefundable unless the return results from our error, a damaged or defective product, or applicable law requires otherwise.

13. Gift Messages and Special Instructions

We will make reasonable efforts to follow gift-message and special-instruction requests. However, requests are not guaranteed unless the applicable option is specifically offered and confirmed during checkout.

We reserve the right to reject messages containing unlawful, threatening, discriminatory, obscene, infringing, or otherwise inappropriate content.

14. Intellectual Property

Unless otherwise stated, the D’Lighted Finds business name, original text, logos, graphics, photographs, website layout, and original designs created and owned by D’Lighted Finds are protected by applicable intellectual-property laws.

Some artwork, fonts, graphics, mockups, product components, trademarks, software, and other materials may be owned by or licensed from third parties. Ownership remains with the applicable owner.

You may not copy, reproduce, republish, distribute, sell, modify, or commercially exploit protected website content without prior written permission from D’Lighted Finds or the applicable rights holder.

Purchasing a product does not transfer ownership of any copyright, trademark, design, or other intellectual-property right associated with that product.

15. Reviews, Feedback, and Communications

If you voluntarily submit a product review, testimonial, photograph, suggestion, or other feedback, you grant D’Lighted Finds permission to use, reproduce, edit, publish, and display that material for legitimate business and promotional purposes, subject to applicable law and our Privacy Policy.

We may remove content that is unlawful, abusive, deceptive, unrelated to the product, infringing, or contains private information.

We will not knowingly alter a review in a way that misrepresents the reviewer’s opinion.

16. Third-Party Services

Our online store is hosted through Shopify. We may also use third-party providers for payment processing, printing, manufacturing, order fulfillment, shipping, analytics, email services, and other business operations.

These third parties may process information only as necessary to provide their services, subject to their applicable terms and privacy practices.

D’Lighted Finds remains the seller responsible for its relationship with customers. However, we are not responsible for interruptions, outages, delays, or acts of independent third-party providers that are outside our reasonable control.

Our website may contain links to third-party websites. We do not control or endorse all third-party content and are not responsible for losses arising solely from a customer’s independent use of a third-party website.

17. Privacy

Your submission of personal information through this website is governed by our Privacy Policy.

By using the website or placing an order, you acknowledge that information may be processed by Shopify and other service providers as necessary to operate the store, process payment, produce products, fulfill orders, and provide customer support.

18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, this website and its content are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, or error-free. We do not guarantee that every product will appear exactly the same as it does on a customer’s screen or in a digital mockup.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be waived or excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, D’Lighted Finds will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of this website or the purchase or use of our products.

To the fullest extent permitted by law, our total liability for a claim relating to a particular order will not exceed the amount the customer paid for that order.

These limitations do not apply where liability cannot legally be excluded or limited, including any rights or remedies provided by applicable consumer-protection law.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless D’Lighted Finds and its owner, employees, contractors, and service providers from third-party claims, damages, liabilities, and reasonable expenses resulting from:

• Your unlawful misuse of the website;

• Your violation of these Terms;

• Content you submit without the required ownership or permission; or

• Your infringement of another person’s rights.

This section does not require a customer to indemnify D’Lighted Finds for D’Lighted Finds’ own unlawful conduct, negligence, or breach of these Terms.

21. Events Outside Our Reasonable Control

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, fire, labor disputes, government actions, public-health emergencies, transportation interruptions, carrier disruptions, power failures, internet outages, or supply-chain interruptions.

This section does not remove any cancellation, notice, refund, or other rights that cannot legally be waived.

22. Termination

We may suspend or terminate a person’s access to the website if we reasonably believe that the person has violated these Terms, attempted fraud, interfered with the website, or harmed D’Lighted Finds or another person.

Obligations and liabilities incurred before termination will survive termination when appropriate.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed to the minimum extent necessary. The remaining provisions will continue in effect.

24. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

25. Entire Agreement

These Terms and the policies referenced within them constitute the entire agreement between you and D’Lighted Finds concerning your use of the website and purchases from the store.

If these Terms conflict with a product-specific term displayed at checkout, the more specific term will control to the extent of that conflict, subject to applicable law.

26. Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.

Before filing a legal claim, you and D’Lighted Finds agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing a reasonable opportunity to respond.

Unless applicable law requires otherwise, legal proceedings relating to these Terms or a purchase from D’Lighted Finds will be brought in a court with proper jurisdiction serving Sandoval County, New Mexico.

Nothing in this section prevents a customer from exercising rights that cannot legally be waived or filing an eligible claim in small claims court.

27. Changes to These Terms

We may update these Terms from time to time to reflect operational, legal, or regulatory changes.

The updated version will be posted on this page with a revised “Last updated” date. Changes will apply prospectively from the date they are posted unless otherwise stated or required by law.

Your continued use of the website after revised Terms become effective constitutes acceptance of those revisions. The Terms in effect when an order was placed will generally govern that order.
